Terms of Service
Last updated: October 16, 2026
These Terms of Service ("Terms") govern your use of the HOA Booster platform, the community websites and homeowner portals it hosts, and this website (together, the "Service"), operated by HOA Booster ("we," "us," or "our"). Our Privacy Policy explains how we handle personal information and is part of these Terms.
1. Acceptance of Terms
By creating an account, or by accessing or using the Service, you agree to these Terms. If you are accepting them for a homeowners association or other organization (the "Community"), you confirm that you are authorized to do so, and "you" includes the Community. If you do not agree, do not use the Service.
2. The Service
HOA Booster gives community associations tools to run their community, including contact records, requests and violations, documents, meetings, accounting, a community website and homeowner portal, an email inbox, text messaging, a phone line with a call menu and voicemail, printed mail, and newsletters. Features may be added, changed or retired over time. Some features are optional, must be turned on for your Community, or carry separate charges. The Service may include advertising, such as sponsor messages and special offers in community newsletters, on community websites and in the homeowner portal, from businesses the Community's board approves; how it works is explained in our Privacy Policy.
3. Accounts and Access
You must give accurate information when you register and keep it up to date. Each Community decides which of its board members, managers and other users have access, and what each role can do. You are responsible for keeping sign-in details confidential and for activity under your account. Tell us promptly at kimberly@hoabooster.com if you believe an account has been misused.
4. Your Responsibilities for Communications
The Service lets your Community send email, text messages, phone messages and printed mail to homeowners, residents, vendors and others. Your Community is the sender of those communications and is responsible for their content and for having the right to send them, including:
- obtaining any consent required before sending text messages, and honoring opt-outs (the Service stops texting a number that replies STOP until it replies START);
- complying with laws that apply to your communications, such as the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and state privacy and collection laws;
- not using the Service to send spam, harassment, or unlawful, deceptive or infringing content.
We may limit, delay or stop communications that appear to break these rules or that put the Service's sending reputation at risk. Text messages are only sent between 8 a.m. and 8 p.m. in your Community's time zone.
5. Suggestions Made Automatically
Some features sort information automatically. Homeowner emails can be suggested as requests, possible duplicate requests are flagged, and a voicemail from a known homeowner that clearly describes a problem can be opened as a new request in the matching category. Automatic sorting can be wrong. Email suggestions are never acted on until a board member or manager decides, and requests opened from voicemail are reviewed and handled by your Community like any other request. Your Community can turn email suggestions off in Settings. This sorting runs on HOA Booster's own systems; see our Privacy Policy.
6. Payment
Subscription fees, and charges for usage-based services such as printed mail, are shown before you commit to them and are billed to the payment method on file through our payment processor. Mailing charges are taken when a mailing is scheduled. Fees are non-refundable except as required by law or as stated when you buy. We will give at least 30 days' notice of price changes. If a payment fails, we may pause the related service or suspend access until it is paid.
7. Your Data
Your Community owns the data it puts into the Service, including its records, documents, messages and website content ("Community Data"). You give us permission to store, process and transmit Community Data only as needed to provide, secure, support and improve the Service, as described in our Privacy Policy. We do not sell Community Data, and we do not use it to train artificial intelligence models.
Your Community is responsible for the accuracy of its data and for having the right to collect and use it, including homeowners' contact details. Homeowners who ask us about their information will be referred to their Community, and we will help the Community respond.
8. Third-Party Services
We use trusted service providers to deliver parts of the Service, such as email delivery, text messaging and calls, printing and mailing, payment processing, and file storage. The kinds of providers we use are described in our Privacy Policy. Their own terms may apply to features that rely on them; for example, payments are processed under the payment processor's terms.
9. Availability and Changes
We work to keep the Service available and secure, but we do not guarantee it will be uninterrupted or error-free. Messages, mail and calls depend on outside networks, carriers and recipients' mail systems, which we do not control; for example, a recipient's email provider may place a message in a junk folder.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. HOA Booster does not give legal, accounting or tax advice; the Service is a tool, and your Community remains responsible for its decisions, notices and compliance with its governing documents and the law.
11. Limitation of Liability
To the fullest extent permitted by law, HOA Booster is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the fees your Community paid us in the twelve months before the claim arose.
12. Ending Your Use
You may stop using the Service at any time. We may suspend or end access for a breach of these Terms, for non-payment, or to protect the Service or others. When an account ends, you may ask us within 30 days for an export of your Community Data; after that we delete it, except for copies we must keep for legal, tax or security reasons or that remain in routine backups until they expire.
13. Changes to These Terms
We may update these Terms. We will post the new version here with a new "Last updated" date and, for significant changes, tell account holders by email or in the app. Continuing to use the Service after a change takes effect means you accept it.
14. Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules.
